PLEASE READ CAREFULLY AND IN ENTIRETY BEFORE SIGNING! THIS IS A RELEASE OF LIABILITY AND WAIVER OF CERTAIN LEGAL RIGHTS. A signed waiver must be on file for each participant before being allowed in the pool. Please understand the Release of Liability and Waivers are for the Trumbull Marriott, Owners of the Shoreline Swim School LLC and for the Shoreline Swim School LLC.
EXHIBIT A
RELEASE AND INDEMNIFICATION FORM
In consideration of my being allowed to use the pool facilities at the Trumbull Marriott (“Hotel”), I agree as follows:
I agree to abide by all Hotel rules and regulations
I agree not to use the Hotel pool facilities if I have not received clearance from my personal physician and I assume responsibility for obtaining such clearance.
I recognize there are certain risks involved in using the Hotel pool facilities and assume such risks as a condition of my being permitted to use the facilities.
I hereby release and forever discharge the Hotel, its owner and Marriott International, Inc., its subsidiaries and affiliates, and their officers, agents, and employees from all manners of action, causes of action, suits, debts, damages, or claims and demands of any type or kind whatsoever that may arise on account of, any reason or cause, injury or death, whatsoever, occurring from, connected with from my use of the pool facilities.
Furthermore, I agree to indemnify, defend and hold harmless and blameless the above-named parties from and against all liability, claims, suits, demands, damages, judgement, costs and expenses to which any of the above-named parties may be subject by reason of any claim for, any injury to, or death of any person or persons for damage to property or otherwise arising from or in connection with the activity described above.

USE OF SWIMMING POOL AND INDEMNIFICATION
In consideration of the opportunity of_______________________________, a minor (hereinafter “Minor”) to participate in swimming lesson activities at the Trumbull Marriott (“Hotel”) and other good and valuable consideration, the receipt and sufficiency of which consideration is hereby acknowledged, I hereby agree, intending to legally bound as follows:
I recognize there are certain risks involved in participating in swimming lesson activities including but not limited to, bodily injury and death, and assume such risks on my own as a condition precedent to Minors being permitted to participate in any such activities.
For Minor, and his/her heirs, successors and assigns, I hereby release and forever discharge Marriott International Inc., its subsidiaries and affiliates, and the owner of the Hotel, and their respective officers, agents and employees (the “Released Parties”) from any and all actions, ;costs, suits, demands, claims, damages, losses and liabilities (including reasonable attorney’s fees) of any type or kind whatsoever arising out of or caused by Minor’s participation in any such activities.
I hereby agree to indemnify, defend and hold harmless the Released Parties from and against any and all actions, costs, suits, demands, claims, damages, losses, and liabilities (including reasonable attorney’s fees) of any type or kind whatsoever arising out of or caused by Minor’s participation in any such activities.
The undersigned represents that he or she has read and fully understands that this document is a release of liability.
SHORELINE SWIM SCHOOL, LLC Swim Lesson Contract & Waiver Form
Dear Swim Lesson Participant and/or Parent/Guardian (the “Parent”),
Please complete this Waiver of Liability form prior to admittance into swim lessons at Shoreline Swim School LLC (the “Activity” or “Lessons”). The following waiver is required for anyone participating in swim lessons under the instruction of Shoreline Swim School, LLC. Parents are responsible for their child both before and after their Lessons. There are no refunds for missed Lessons once the session begins.
Agreement, Waiver, and Release
I, the Participant or Parent, have carefully read the description of Lessons for which I am/we are registering, and, in consideration for being permitted by the Instructor to participate in the activity, I hereby waive, release, and discharge any and all claims for damages for personal injury, death, or property damage which I may have, or which may hereafter inure to me, as a result of participation in Lessons. I hereby acknowledge that participation in Lessons does not guaranty that I/my child will be water-safe. This release is intended to discharge in advance the Instructor, Director, Owner and Shoreline Swim School LLC from any and all liability arising out of, or connected in any way, with my participation in the Lessons, even though that liability may arise out of negligence or carelessness on the part of Instructor. It is understood that this Activity involves an element of risk and danger of accidents, and knowing those risks, I hereby assume those risks. It is further agreed that this waiver, release and assumption of risk is to be binding on my heirs and assigns. I agree to indemnify and to hold Instructors free and harmless from any loss, liability, damage, cost, or expense which they may incur as the result of my or my child’s death or injury or property damage that I may sustain while participating in the Activity. The parent/guardian of the participant authorizes any representative of the Shoreline Swim School to have the participant treated in any medical emergency during their participation in the Shoreline Swim School. Further, the parent/guardian of the participant and/or the participant agrees to pay all costs associated with medical care and transportation for the participant.
Parental Consent

I hereby consent that___________________________ (child’s name) may participate in the Activity, and I hereby execute the above agreement, waiver, and release on his/her behalf. I hereby assert that my child is physically able to participate in said activity. I hereby agree to indemnify and hold harmless the Instructor and Shoreline Swim School from any loss, liability, damage, cost, or expense, which may occur as a result of death or injury, or property damage, that my child may sustain, while participating in the Activity.
I HAVE CAREFULLY READ THIS AGREEMENT, WAIVER, AND RELEASE AND FULLY UNDERSTAND ITS CONTENT. I AM AWARE THAT THIS IS A RELEASE OF LIABILITY AND A CONTRACT BETWEEN THE SHORELINE SWIM SCHOOL, LLC AND ME, AND I SIGN IT OF MY FREE WILL.
COVID-19 Waiver of Liability
This waiver, which is in addition to the general waiver liability above, release Shoreline Swim School LLC, its officers, directors, employees, agents and assigns from any liability should my child/ and or I, my spouse, legal guardian accompanying the child/ children during swim lessons contract COVID-19 Coronavirus or other related illnesses during the swim lessons conducted during the years 2020 and 2021.
I, (signed name below) members of my household, and my child/ children participating in lessons do hereby affirm and state: in the past 14 days have not had: a fever, cough, shortness of breath, sore throat, loss of smell, gastrointestinal symptoms (vomiting, diarrhea etc.) or any other symptoms known to be indicative of COVID-19 Coronavirus or related illnesses. If any of these symptoms arise in my household, I will notify Shoreline Swim School LLC and not participate in lessons to ensure the safety of our instructors and clients.
By signing this waiver below, I agree to hold Shoreline Swim School LLC harmless and entirely free from any liability whatsoever, including financial or psychological harm, in the event that I, my child/children contract the COVID-19 Coronavirus or a related illness. Further, this waiver explicitly applies to my spouse, and any other legal guardian accompanying my child/children the lessons referred to above.
Lesson Policy
Make-Up Policy:
Shoreline Swim School has a strict 1 make-up class policy. Must provide 24 hours notice for any absence so we can schedule accordingly. Make-up classes are conducted by all instructors at Shoreline. Clients may not choose which instructor they prefer for a make up class. Shoreline does not keep track of missed lessons, the client is responsible for scheduling a make-up. Shoreline will make every effort to provide a make-up class, however clients must choose from classes offered by Shoreline due to scheduling and space confinements. Lessons that are unable to be rescheduled based on the criteria previously mentioned, will not carry over to upcoming sessions. Please note, Shoreline Swim School does not host make-up lessons during the last week of a session due to staffing and scheduling constraints. Shoreline Swim School is not responsible for any make-up classes that are not scheduled before the last week of the session.
*For semi-private lessons, both students must miss the same lesson in order to be granted a make-up lesson.
Pool/ Spa Use Policy:
Only Person(s) enrolled in Swim Lessons by the Shoreline Swim School are permitted to use the pools and only during their scheduled lesson time under the direct supervision of the Shoreline Instructor. Hot tub/ Spa use is strictly prohibited by all. This is for safety and liability reasons.
Inclement Weather Policy:
In the event the Shoreline Swim School is closed due to inclement weather, Shoreline will provide a make up class. Make up classes are conducted by all instructors at Shoreline. Clients may not choose which instructor they prefer for make ups. Clients must check their email for updates on cancellations.
Refunds:
Shoreline Swim School has a no refund policy. No cash refunds will be made once the session begins.
Incidents in the Pool:
Oh poop. We know it’s frustrating, but unfortunately, accidents do happen – especially when we teach hundreds of children how to be safe in and around pools- every day! It is MANDATORY that any child not 100% fully toilet trained must wear BOTH a swim diaper AND cover. Shoreline requires the use of both.
If an incident occurs in the pool causing the closure of lessons there is a $40 fine.
The best thing to do to help us prevent a bathroom incident is to make sure your child uses the bathroom before coming to swim class. There are bathrooms located in the main lobby and in the pool room.
Hotel Guests:
Shoreline does not own the pool and therefore is not responsible for hotel guests. Occasionally, the pool is busy particularly during holidays, spring vacation periods, and during the warmer seasons. We also have no way to predict what times the hotel may be busier so we cannot plan lessons around this.
How does Shoreline respond to this? Our instructors are trained to maximize each lesson regardless of outside factors. It is important for students to learn in a busy environment in moderation to be sure they are water safe no matter the setting (parities, public pools, beaches).
Please be mindful that if the pool is too busy for your comfortability during a particular lesson, feel free to use a make up lesson if you have not already.
Shoreline Swim School is in compliance with CT Reopens Section 2.1: SPORTS, SPORTS CLUBS & COMPLEXES, GYMS, FITNESS CENTERS, & POOLS
Shoreline Covid-19 Policy Change:
Parents can now sit in the pool room
Shoreline instructors will have the option to wear face-shields
Please be mindful that lessons are limited to one to two parents per household. This helps to limit distractions during lessons and minimize foot traffic
If you, your child, or any of your household test positive for the COVID-19 virus, or display the common symptoms do not attend lessons
Instructor Covereges
It is part of the Shoreline Swim School LLC program that students occasionally work with a different instructor, outside of the instructor they signed up with. This is to allow students to get familiar and exposed to different instructors with slightly different teaching styles. However, all Instructors follow the Shoreline Curriculum and Lesson Plans. They are also Lifeguard Certified and CPR certified. Parents should expect their students to swim with a different instructor at least once a session. Please note, we provide notice on Instructor changes if it is a long term change.
If an Instructor has to be absent, Shoreline Ownership arranges for Instructor to coverage based on staffing and availability. Shoreline Administrators may or may not provide advanced notice for the Instructor change. If notice is provided by Shoreline Administrator, Clients may not request or be edible for a Make-Up simply due to a change of Instructor.
Privacy Policy
Information Collection, Use, and Sharing
We are the sole owners of the information collected on this site. We only have access to/collect information that you voluntarily give us via email or other direct contact from you. We will not sell or rent this information to anyone.
We will use your information to respond to you, regarding the reason you contacted us. We will not share your information with any third party outside of our organization, other than as necessary to fulfill your request, e.g. to ship an order.
Unless you ask us not to, we may contact you via email in the future to tell you about specials, new products or services, or changes to this privacy policy.
Security
We take precautions to protect your information. When you submit sensitive information via the website, your information is protected both online and offline.
Sharing Photos
Participants agree to be filmed and photographed and to have his/her image and voice otherwise recorded in any media by the Shoreline Swim School and grants Shoreline Swim School the irrevocable worldwide right and license to use, in all media, likeness, picture, voice, for promotion of Shoreline Swim School.
Lost and Found
Shoreline is not responsible for lost or stolen goods.
Changes to All Policies
Shoreline Swim School reserves the right to change and update these policies at any time.
